1. Introduction

These Terms and Conditions govern the use of the Medulin Boat Tour website and the booking or participation in our private boat tour services. By contacting us, making a reservation, or joining the tour, you agree to these Terms and Conditions.

2. Operator details

3. Service description

Medulin Boat Tour provides private boat tour experiences from Medulin, Croatia, including island hopping, swimming, snorkeling, and water activities. The exact route, activities, and trip pace may vary according to weather, sea conditions, safety, and the captain's judgment.

4. Booking and confirmation

Reservations are currently handled by WhatsApp or direct communication with our team. A booking is confirmed when we acknowledge your request and agree on the trip details. No deposit or advance payment is required to reserve the trip unless we expressly agree otherwise in writing.

5. Payment

Payment is made on the boat upon arrival and before departure. Payment can be made by cash or card, subject to the availability of the card terminal and any limitations of the payment provider. We do not store full card details ourselves.

6. Guest capacity and supervision

The maximum guest count is 12 people. There is no minimum age limit, but at least one adult guest must supervise any minor guests. You are responsible for providing accurate guest counts and for ensuring that minors remain properly supervised at all times.

7. Guest conduct and safety

All guests must follow the captain's and crew's safety instructions, behave responsibly, and use any provided equipment only as instructed. We may refuse service or stop an activity if a guest's behavior creates a safety risk or materially disrupts the trip.

8. Late arrival

Guests are expected to arrive on time. The agreed ending time does not change because of late arrival, and any delay may reduce the actual duration of the trip. We encourage guests to arrive early enough to avoid shortening the experience.

9. No-show

If a guest or group does not arrive at the agreed time, the reserved slot may be lost. Because no deposit or prepayment is taken, there is generally no charge to forfeit, but we strongly encourage timely communication so the slot can be reassigned or the plan adjusted where possible.

10. Weather and route changes

The captain may change the route, activity plan, departure time, or duration of the tour for safety or weather reasons. In bad weather, we will try to offer the client another available date that is suitable for them, subject to availability.

11. Cancellations, rescheduling and refunds

Cancellations, no-shows, late arrivals, weather changes, rescheduling, and refund conditions are handled as follows: please contact us by WhatsApp, phone, or email as soon as you know you need to cancel or change your reservation. We do not require a deposit or advance payment, so a guest cancellation or no-show normally does not involve forfeiture of an advance payment. If bad weather or unsafe sea conditions arise, we will try to offer another available date and, where we must cancel or interrupt the trip for safety or operational reasons, we will work with you to reschedule first where possible. Refunds are possible only when the interruption or cancellation is caused by the service provider, or when another refund is required by applicable law. If the interruption is caused by the client, including through unsafe behavior, late arrival, or a no-show, a refund is not available unless mandatory law requires otherwise. If a refund is approved, we will normally use the same payment method that was used on board, or another agreed method if the original method is no longer practical. Special arrangements or third-party services may have different conditions, and we will tell you that before confirmation.

12. Safety, liability and waiver

Boat travel, swimming, snorkeling, boarding and disembarking, and optional water activities involve inherent risks such as slips, falls, collisions, fatigue, sun exposure, dehydration, seasickness, equipment misuse, changing sea conditions, and contact with marine life or underwater surfaces. Each guest is responsible for acting carefully, following safety instructions, and using equipment only as directed by the captain or crew. The captain has authority to change the route, activity plan, departure timing, and onboard procedures for safety reasons, and the crew and guests must obey those instructions immediately when safety is involved. Guests are also responsible for their own belongings, including phones, cameras, jewelry, cash, and other valuables. To the maximum extent permitted by law, we are not liable for losses or damages caused by inherent risks, guest misconduct, failure to follow instructions, or events beyond our reasonable control. Nothing in these Terms limits liability that cannot legally be excluded under Croatian law.

13. Medical suitability and disclosure

The service is not suitable for wheelchair guests. There is no minimum age limit, but at least one adult guest must supervise any minors at all times. Guests should inform us in advance about any medical condition, injury, pregnancy, mobility limitation, or other issue that could affect safe participation so we can assess suitability before departure. If we believe participation is not safe, we may refuse or limit access to certain activities.

14. Alcohol and drugs

Zero drugs policy applies before and during the trip. Guests will not be allowed to embark if they are under the influence of alcohol to a level that may affect safety or conduct. Moderate alcohol consumption may be allowed for adult guests where it does not create a safety concern, but underage guests may not consume alcohol.

15. Safety equipment and emergency response

Safety equipment is provided by the service provider. Life jackets are not required to be worn at all times, but they must be worn immediately in an emergency or whenever the crew requests it. In an emergency, guests must remain calm, follow crew instructions, and cooperate with any safety, rescue, or medical response. If a guest needs urgent medical assistance, the captain may contact emergency services or take other necessary action.

16. Liability, indemnity and acknowledgement

To the maximum extent permitted by law, WAVE BOAT, its owner, crew, and affiliates are not liable for injury, loss, damage, delay, or expense arising from the inherent risks of the experience, guest misconduct, failure to follow instructions, or events beyond our reasonable control. Where permitted by law, you agree to be responsible for claims, losses, or costs arising from your own actions, negligent behavior, or breach of these safety instructions and terms, to the extent such responsibility is legally enforceable. By joining the tour or participating in any water activity, you acknowledge that you have read this waiver language, understand the risks, and agree to follow the rules and instructions provided by the captain and crew.

17. Third-party services

The website and service may involve third-party providers such as WhatsApp, Google Maps, and email or payment providers. Those services are governed by their own terms and privacy policies, and availability may change independently of us.

18. Intellectual property

All website content, branding, photographs, text, and related materials are owned by Medulin Boat Tour or used with permission, unless stated otherwise. You may not copy, reproduce, or redistribute our materials without prior written consent, except where permitted by law.

19. Governing law and jurisdiction

These Terms and Conditions are governed by Croatian law. Any dispute arising from or in connection with these Terms shall, where permitted by law, be submitted to the competent courts in Pula, Croatia.

20. Changes to these terms

We may update these Terms and Conditions from time to time to reflect changes in the service, legal obligations, or operational requirements. The updated version will take effect when posted on the website, unless a later date is specified.
